Acceptable Use Policy

This Acceptable Use Policy (AUP) governs JepNest LLC and its suppliers, brands, and affiliates (“JepNest”) provide hosting services, hosting solutions, cloud services, and other offerings (the “Services”) under this AUP.

The terms under which JepNest grants you access to or use of the Services include this AUP. Access to or use of the Services constitutes your acceptance of this AUP.

Additionally, JepNest maintains the right to change this AUP at any moment, which will take effect immediately upon posting or notifying you.

General Statement

The purpose of this AUP is to set forth guidelines for the expected conduct of users of the Services and the types of actions and content that are contrary to JepNest’s mission and philosophies. This AUP is intended to protect the Services, employees and customers of JepNest, and end users from improper, inappropriate, abusive or illegal activity. JepNest may suspend or terminate your right to access and use the Services if, in its sole determination, it believes you have violated this AUP.

Responsibilities and Prohibited Use

You are responsible for the activities of your agents, representatives, and end-users (“Users”) and will they abide by this AUP.

Moreover, you shall use the Services solely for legitimate business and commercial purposes and not for activities that, in JepNest’s sole discretion, may be illegal, offensive, abusive, or that interfere with or adversely affect the Services or use of the Services (including deliberate attempts to overload a system and broadcast attacks) or expose JepNest to criminal or civil liability.

Some examples of prohibited activities follow, but this is not an exhaustive list. You and your Users agree not to use the Services for:

1. Hacking, phishing, spamming, scamming, identity theft, fraud, forgery, deception, virus or malware distribution, network attacks, and interfering with other users’ Services.
2. The unauthorized access, monitoring, collection, or use of data, systems or networks.
3. Transmitting, distributing, or storing illegal, fraudulent, or infringing information or material.
4. Harassment or transmitting or distributing content that is improper, obscene, defamatory, threatening, abusive, promotes violence, or breaches a law, regulation, or public policy.

In addition, you and your Users must also comply with data protection, privacy, and unsolicited commercial electronic message laws when using the Services.

JepNest’s Rights

Furthermore, JepNest reserves the right at all times to investigate any actual, suspected, or alleged violations of this AUP.

Additionally, you must fairly assist JepNest in investigating and addressing any AUP violation by yourself or any User.

Moreover,JepNest may disclose the identity of any User it believes violated the AUP to legal authorities and other parties.

JepNest may implement technical mechanisms to prevent AUP violations.

In addition, nothing in this AUP shall restrict JepNest’s rights and remedies, both at law and in equity, that may be available.

Consequences of Violations of this AUP

JepNest may suspend your Services, terminate your agreement, or block communications without notice if it reasonably believes you or your User violated this AUP.

Furthermore, JepNest may also charge you its usual hourly rate, reasonable legal expenses, and the cost of equipment and materials needed to investigate, respond to, and resolve any AUP violation.

Disclaimer

JepNest isn’t obligated to monitor user activities and disclaims responsibility for any User’s misuse of the Services.

Additionally, JepNest disclaims responsibility for User or third party material on the Services and is under no responsibility to monitor or control it.

Moreover, JepNest retains the discretion to block access to material that breach this AUP and/or exposes JepNest to civil or criminal liability; however, there is no responsibility to do so.

Furthermore, individuals who doesn’t agree to use the Services are not bound by any responsibility from JepNest unless explicitly stated in this AUP.

Notification of Violations

You must tell JepNest through the Abuse Report Form if anyone, including your Users, doesn’t follow this AUP. Click here.
